Homeowner Property Maintenance Requirements

Being a homeowner entails several additional duties related to property care. The owner cannot neglect to make necessary repairs and let their property deteriorate. All properties are subject to the City of Ottawa Property Standards bylaw and Property Maintenance bylaw. These bylaws are in place for legitimate reasons, such as maintaining health and safety standards and avoiding vermin infestations. According to the City, property owners are required to make necessary repairs, keep the property in good shape, and keep it up to bylaw requirements while also removing any hazards.

Homeowners who do not maintain their properties according to these bylaws may be fined by the City or have the work done at the owner’s expense.

Yards

In addition to safety rules, there are other rules that apply to yard maintenance because yards are visible to the general public. A homeowner must maintain groomed lawns and may not allow dense undergrowth to takeover the land. A homeowner cannot completely do away with their lawn because a cultivated or groomed yard helps to stop soil erosion. Additionally, a homeowner is not permitted to store abandoned and discarded objects on their yard. It is necessary to properly dispose of abandoned cars and broken appliances like stoves and refrigerators. A car that is being fixed up for future usage is allowed. Firewood, building supplies, and gardening equipment may be stored, but only for a maximum of 15% of the year.

Pathways

Pathways must be kept free at all times. In the winter, snow and ice must be removed, and in the summer, walkway holes must be patched. To ensure everyone's safety at night, walkways must be lit. The safety of visitors to the property and the homeowner's immunity from legal action in the event of a slip and fall accident on their land are both enhanced by the clearing of walkways. If the walkway is dangerous for their staff, Canada Post won't deliver to the door.

DRIVEWAYS

Although you do not require a building permit to establish a new driveway or widen your driveway, zoning regulations and/or site plan control may impose restrictions on the width and location of your driveway. You may want to review the deed of transfer of your property with your lawyer prior, as it may include other restrictions.

Fencing

Fences must be maintained in good condition and cannot deteriorate. This covers refinishing damaged and old paint as well as mending broken fencing. Homeowners are required by the City of Ottawa to remove offensive stains and graffiti. Even if you are the target of graffiti, the homeowner is still legally required by the Graffiti Bylaw to remove the art.
